Four South African Police Service (SAPS) officers and a police informer have been sentenced to an effective 15 years’ direct imprisonment each after being convicted of orchestrating the robbery of approximately R1.2 million from three foreign nationals and kidnapping the victims during an unlawful operation in Randburg.
The National Prosecuting Authority (NPA) on Wednesday welcomed the sentencing handed down by the Randburg Magistrates’ Court against Walter Enow Agbor, Tebogo Michael Moeketse, Choema Eric Moabelo, Isram Moaone Phala and Kagiso Arthur Masibi.
The five accused were convicted on multiple charges, including robbery, corruption, kidnapping, theft and defeating the ends of justice.
NPA spokesperson Magaboke Mohlatlole said the offences stemmed from an unlawful operation conducted in Randburg on 8 May 2018, during which a Nigerian national and two Congolese nationals were targeted and dispossessed of about R1.2 million.
Investigations by the Serious Corruption Investigation (SCI) Unit revealed that the operation had no legal basis.
"Investigations established that no lawful arrests had been effected, no criminal cases had been registered, and the money allegedly seized during the operation could not be accounted for," Mohlatlole said.
The probe, led by Captain Phatlane of the SCI Unit in the Vaal Rand, uncovered what prosecutors described as a coordinated criminal enterprise involving the unlawful seizure of money, the kidnapping of the victims and attempts to obstruct justice.
Authorities said some of the accused were found in possession of cash linked to the crime, while others were arrested while allegedly trying to create a false paper trail to conceal their involvement.
During sentencing proceedings, Senior Public Prosecutor Yusuf Baba argued for a harsh sentence, stressing that the accused had betrayed the very principles they had sworn to uphold.
"He submitted that the accused had a constitutional and legal duty to uphold and enforce the law, yet abused their positions of authority to commit serious offences," Mohlatlole said.
The prosecution further highlighted that four of the convicted individuals were serving police officers, two attached to the Provincial Investigating Unit and two Yeoville detectives, whose actions represented a profound breach of public trust.
The court agreed with the State's arguments and sentenced each accused to a cumulative 38 years' imprisonment. However, because the sentences were ordered to run concurrently, each will serve an effective 15-year prison term.
In a further blow to the convicted group, the NPA's Asset Forfeiture Unit secured a confiscation order under Section 18 of the Prevention of Organised Crime Act (POCA), resulting in R282,500 seized during the investigation being forfeited to the Criminal Assets Recovery Account (CARA).
Welcoming the outcome, the NPA praised the investigators and prosecutors responsible for the case.
"Their commitment to ensuring accountability for corruption and abuse of authority reinforces public confidence in the criminal justice system and the rule of law," Mohlatlole said.
